Driving license
The right to drive vehiclesAny natural person, who has reached the age limit provided in the second part of this article, fits for driving in terms of health, knows the traffic rules, has driving habit and license, is entitled to drive vehicles in the territory of Azerbaijan Republic.
II. The right for driving the vehicles on roads in Azerbaijan Republic territory begins from these ages:
1) The right to drive a bicycle or a cart –from the age of 14
2) The right to drive bicycle with pod-type engine, moped and vehicles included in “A1” category - from the age of 16
3) The right to drive vehicles included in “A”, “B”, “C” categories - from the age of 18
4) The right to drive vehicles included in “BE” category - from the age of 19
5) The right to drive trams, trolleybuses, vehicles included in “CE” and “D” category - from the age of 21
6) The right to drive vehicles included in “DE” category - from the age of 24.
Persons with at least one year experience to drive “B” category vehicles have the right for driving “BE” category vehicles, and the persons with at least three years experience to drive “C” and “D” category vehicles have the right for driving, appropriately, “CE” and “DE” category vehicles.
Military servants may get the right to drive “CE”, “D” and “DE” category vehicles from the age of 19 as specified by the legislation.
The grounds for considering any person able to drive from health view point, as well as the list of diseases and physical defects hindering him/her from driving vehicles, are determined by the respective executive body of Azerbaijan Republic.
Other than the data provided in the third part of this article, the following categories of vehicles to which the power of driving right concerns, are rendered on driving licenses issued for driving automobiles and motorcycles:
“A1” – to drive the motorcycles with engine, swept volume of which is not more than 125 sq/cm and engine power of which is not more than 11 kw.
“A” – to drive all kinds of motorcycles.
“B” - to drive the following vehicles:
Automobiles not belonging to “A” category, the maximum allowable weight of which is not more than 3.500 kg and the number of seats of which is not more than 8 in addition to the driver’s seat;
Automobiles of “B” category with trailer, the maximum allowable weight of which is not more than 750 kg;
Automobiles of “B” category with trailer, the maximum allowable weight of which is more than 750 kg, but not more than unladen weight of the automobile and with such composition, the maximum allowable weight of which is not more than 3500 kg in whole;
To drive automobiles not belonging to “C” - “D” category, the maximum allowable weight of which is more than 3.500 kg, as well as automobiles of “C” category with trailer, the maximum allowable weight of which is not more than 750 kg;
“D” - To drive automobiles of “D” category, intended for passenger transportation and the number of seats of which is more than 8 in addition to the driver’s seat, also with trailer, the maximum allowable weight of which is not more than 750 kg;
“BE” - To drive automobiles of “B” category with trailer, the maximum allowable weight of which is more than 750 kg and more than unladen weight of the automobile, also automobiles with trailer, the maximum allowable weight of which is more than 750 kg and with such composition, the maximum allowable weight of which is more than 3500 kg in whole;
“CE” - To drive automobiles of “C” category with trailer, the maximum allowable weight of which is more than 750 kg;
“DE” - To drive automobiles of “D” category with trailer, the maximum allowable weight of which is more than 750 kg;
“Tram” – to drive trams;
“Trolleybus” – to drive trolleybuses.
The persons being on the books of psychiatric and narcological dispanseries in accordance with the diseases provided in the list made by the respective executive body of Azerbaijan Republic, having less than three-year driving experience, deprived of the driving right because of harming people and committing traffic accident resulted in their death, as well as for driving the vehicle in a drunken state, in last two years, are not allowed to drive buses, trams and trolleybuses.
Driving license
Driving license is a document certifying any person’s right to drive vehicles.
Depending on the types of the automotive vehicles, there are the following types of driving licenses issued in Azerbaijan Republic:
To drive motorcycles, automobiles, trams and trolleybuses;
To drive tractors and other automotive vehicles.
Irrespective of the type, on each driving license, there is distinctive mark of Azerbaijan Republic in international traffic - "AZ" and the following numbered data:
Surname of the bearer;
Name and patronymic of the bearer;
Date and place of birth of the bearer;
Place of residence of the bearer;
Name of the issuing body;
Date and place of issue;
Expiry date of the license;
License number;
Official’s signature, stamp or seal of the issuing body;
Blood group and signature of the bearer;
Special remarks.
Other than the data provided in the third part of this article, the following categories of vehicles to which the power of driving right concerns, are rendered in driving licenses issued for driving automobiles and motorcycles:
“A” – to drive motorcycles;
Automobiles not belonging to “B” – “A” category, the maximum allowable weight of which is not more than 3.500 kg and the number of seats of which is not more than 8 in addition to the driver’s seat;
To drive automobiles not belonging to “C” - “D” category, the maximum allowable weight of which is more than 3.500 kg;
“D” - To drive automobiles intended for passenger transportation and the number of seats of which is more than 8 in addition to the driver’s seat;
“E” – to drive the vehicles, trailer of which belongs to “B”, “C” or “D” categories, but the compositions of which don’t in whole belong to the same category or one of those categories;
“Tram” – to drive trams;
“Trolleybus” – to drive trolleybuses.
The period of validity of the license is as follows:
For the persons who have reached 60 – 10 years;
For persons of 60 and more than that – left period by the time they reach 70;
For persons of 70 and more than that – 2 years;
For persons having the diseases, the list of which is defined by the respective executive body of Azerbaijan Republic – the period indicated on the medical reference presented by them, but not more than 2 years.
The name of the driving license is written in state language of Azerbaijan Republic and French ("Permis de conduire"), name of the data rendered in the 1st and 11th items of the third part of this article is written in Azerbaijani and English, and other date are rendered in Azerbaijani.
Owner of the driving license is obliged to securely keep the driving license issued to him/her.
Driving licenses issued by authoritative bodies of foreign states in respect to international standards and still valid licenses are in force in the territory of Azerbaijan Republic as well.
Issuance and change of the driving licenses
Any person intending to get driving license, provided in the first part of the 33rd article of the Law “On Road Traffic”:
Should be trained in volume provided in education plans and programs for preparing the vehicle drivers of appropriate category;
Should pass theoretical exams on traffic rules and practical exams on vehicle driving habits;
Should pay fee in the amount as specified by the legislation of Azerbaijan Republic.
A person intending to get driving license should apply to the appropriate executive body of Azerbaijan Republic. The following documents are attached to the application:
Identification card of citizen of Azerbaijan Republic (appropriately, registration certificate of a foreigner in the territory of Azerbaijan Republic or identification card of a stateless person for the use within the borders of Azerbaijan Republic);
The certificate of the educational institution about the training in volume provided in education plans and programs for preparing the vehicle drivers of appropriate category or document about the register in respective executive body of Azerbaijan Republic in accordance with the training;
Medical reference in certified form by respective executive body of Azerbaijan Republic;
Payment receipt for issuance of driving license.
Respective executive body of Azerbaijan Republic checks the documents provided in the second part of this article for issuing driving license and according to the data rendered there, solves the issue on access to theoretical exams on traffic rules and practical exams on vehicle driving habits.
The following persons meeting the demands of age and health state specified by the law are allowed to take theoretical exams on traffic rules and practical exams on vehicle driving habits during 10 days after the entrance of their applications to respective executive body of Azerbaijan Republic:
Alumni of the courses for training drivers and improving their qualification;
Alumni of the higher and secondary educational institutions for training the personnel on specialization “motor vehicles”;
Persons prepared for exams independently, as specified by respective executive body of Azerbaijan Republic.
The driving license is issued during one day by respective executive body of Azerbaijan Republic, to persons successfully passed the theoretical exams on traffic rules and practical exams on vehicle driving habits in exam registration points. Issuance of driving licenses is realized according to the legislation “On examining the persons who intend to get driving license giving the right to drive a vehicle and rules of giving driving licenses” specified by respective executive body of Azerbaijan Republic.
The grounds for changing the driving license are the ones rendered below:
Expiry date of its validity;
Changing the name, surname and patronymic of the bearer;
Inaccuracy disclosure in writing
Its becoming useless;
Its loss;
Changing the driving licenses within the country as a result of the certification of its new model, as specified by this Law.
Change of driving license is realized on bearer’s application during a day by respective executive body of Azerbaijan Republic without exams and by maintaining all his/her previous categories.
For the change of driving license, excluding the case provided in the 3rd item of the sixth part of this article, duty is collected as specified by respective executive body of Azerbaijan Republic. Fine is paid in amount specified by the legislation, in case of changing the driving license because of its loss.
For the purpose of changing the categories indicated on driving license, change of driving license is realized due to the rule provided in the first and fourth parts of this article.
Centralized registration of data on driving licenses issued by respective executive body of Azerbaijan Republic should be conducted by that body.
Any person may apply to the court as specified by this Law, for the reasons of ignoring the application about issuing or changing driving license or delaying such application, as well as, non-admission to the theoretical exams on traffic rules and practical exams on vehicle driving habits.
Persons, guilty in ignoring the application about issuance or change of driving license or delaying it, groundless non-admission to the theoretical exams on traffic rules and practical exams on vehicle driving habits, at the same time in damaging driving license on purpose, stealing it, in its illegal preparation, forging, selling or its illegal use in contravention of the requirements of this Law, are in charge as specified by the legislation of Azerbaijan Republic.
According to the Law of Azerbaijan Republic “On state due”, driving license form costs fifteen manat.
