First registration of vehicles
Regulation on implementing state registration of automotive vehicles, their trailers in a defined manner, and their record keeping by state registration1. General provisions
1.1. This regulation has been prepared in accordance with the Law of the Azerbaijani Republic "On Road Traffic"; Decree "On Road Traffic" No.24, dated November 22, 1998 of the President of the Azerbaijani Republic and defines rules of state registration of all automotive vehicles, their trailers (hereinafter "transportation means") belonging to legal and natural persons and their record keeping (hereinafter "registration") by state registration in the territory of Azerbaijani Republic.
1.2. Not depending on a form of property and an organizational-legal form, all legal and natural persons should realize state registration of the following transportation means belonging to them:
1) automotive vehicles of all type, make and model, their trailers (semitrailers) having engines with 50 cm3 and more working volume, constructive maximal speed of which is more than 50 km/hour in the Ministry of Internal Affairs of the Azerbaijan Republic;**
2) tramways and trolleybuses in local executive bodies;**
3) Caterpillar automotive vehicles (tractors) not intended for exloitation in commonly used network of streets, automotive vehicles used in agriculture and other automotive vehicles in the Ministry of Agriculture of the Azerbaijan Republic;**
4) Technological vehicles not intended for exloitation in commonly used network of streets in the State Agency for the Safe Conduct of Work in Industry and Mining Control; **
5) sports vehicles intended for competition in the Ministry of Youth, Sports and Tourism of the Azerbaijani Republic; **
Unified state registration of automative vehicles belonging to the Armed Forces of the Azerbaijani Republic and other units is carried out in the Ministry of Defence of the Azerbaijani Republic.
State registration of automative vehicles belonging to other armed units is implemented by the same state bodies.
1.3. State registration is carried out for the purpose of compatibility of constructions, technical state and equipment of vehicles to the adopted security rules, making changes in records during exploitation or retirement of vehicles, defining military service of vehicles, payment of due or taxes and payings by vehicle owners, implementing vehicle registration in a centralized and regional manner as well, struggling against crime and other violantions of law.
Registration of a vehicle is carried out in the name of its owner (legal and natural persons) and registration of vehicles in common use only in the name of one person. State registration certificates or state registration signs of vehicles (2 for cars, 1 for motorcycle, tractor and trailers) are issued to owners of vehicles, permanent record keeping of which are implemented by registration.
Note: Additional state registration signs may be issued to vehicles with the permission of leadership of the Ministry of Internal Affairs of the Azerbaijan Republic for usage of special service and operational bodies along with state registration signs issued during registration.
1.4. Legal and natural persons should make their vehicles be registered at the bodies realizing registration of vehicles by a legal address and a place of residence:
1) within ten days since its procurement;
2) within ten days since changing of natural person's place of residence and legal person's location;
3) within ten days since accepting vehicles as a pledge;
4) within ten days since accomplishment of customs legalization when brought from foreign countries;
5) within ten days since altering vehicle engine, body and chassis numbers or emergence of other cases requiring change of registration data.
1.4. Conducting operations in connection with vehicle registration, repeat registration, deregistration, documentation related to its being put in pledge, changing technical records etc. hereinafter will be called "registration acts".
1.5. Bodies realizing state registration of vehicles perform the following ones in relation to their record keeping by state registration:
manufacture or order of state registration certificates, state registration signs of vehicles and other special products and equipments;
record-keeping of data on vehicle registration, documentation of its alienation, its being pledged;
issuing registration certificates and state registration signs of vehicles;
execution of record-keeping of registered vehicle in regional and centralized manner and collection of data necessary for this purpose;
distribution of state registration signs for vehicles among regions by series;
provision of its structural units with blanks of vehicle registration certificates, state registration signs, as well as other special products and equipments;
Keeping control over usage of state registration signs, vehicle registration certificates and other special products let to these sections and conducting their periodical audit;
The Ministry of Internal Affairs of the Azerbaijan Republic carries out record keeping of commercial organizations, commission shops engaging in sale of vehicles and their spare parts, provision of sold automobiles with "transit" signs and final invoice blanks for temporarily allowing them to access road traffic and correspondingly keeps periodic control over their exploitation.
1.7. Only investigating, judicial and other bodies set in the legislation are entitled to get information from registration base related to registration of vehicles being on record and registered vehicles and their owners carried out in a centralized and regional manner.
1.8. Within the territory of the Azerbaijan Republic it is strongly forbidden to drive:
1) vehicles without state registration or customs obligations on their return;
2) vehicles without state registration signs and lacking one of them, as well as with false state registration signs or state registration signs issued to other vehicles or being incompatible with the state standard.
2. Vehicle registration
2.1. Transportation means are registered in the name of natural persons who have reached the age of 18, bicycles with a pod-type engine, mopeds and motocycles are registered in the name of natural persons who have reached the age of 16, excluding registration of inherited transportation means. When transportation means are registered in the name of a juvenile heir/heiress, a name of his/her parent, foster father/mother (adopter), guardian is shown in a registration document and deregistration of such transportation means without consent of a guardianship body is prohibited.
2.2. Natural person's transportation means are registered by their permanent or temporary (in the absence of permanent registration) place of residence.
It is allowable to register a vehicle at the place of residence of its owner's relatives or at the previous place of residence to where an owner returns back after termination of a contract period, completing education, or military service under bipartite written agreement when causes hindering owner's registration by the place of residence appear (owner's going to a temporary work place under a contract, for studying, military service or to a place where driving a vehicle is impossible for other reason). In these cases an owner of a vehicle should present confirming documents on the above-mentioned matters.
2.3. Legal person's transportation means are registered by their location site at the state registration bodies. Transportation means under usage of non-legal person branches, sections and other components of office, enterprise and organizations may be registered at their location sites. In this case, in a registration certificate of a vehicle, a name, an address of an owner-legal entity and additionally, an address of a branch using a vehicle are shown.
2.4. Except motor transport means manufactured by machine-building plants and under the technical conditions confirmed by the Ministry of Defense, when motor transport means are registered, owners should present to a registration point a certificate (its xerocopy) issued by the State Traffic Police Department in connection with ensuring traffic security of vehicle construction. If there are conditions confining movement conditions of a vehicle, appropriate notes on a content of a restriction are taken in a vehicle registration certificate and record card.
2.5. There should be color and identification signs conformable to the state standard "Operational service vehicles, colored graphical schemes, identification signs, special light and sonic signals" and other standards, as well as regional standards prepared on their basis on the special vehicles to which these standards are referred.
2.6. Bodies realizing state registration of vehicles should carry out state registration and permanent record-keeping, issue of vehicle registration certificate and state registration signs of a vehicle within one day after giving due documents by a vehicle owner and or other person entitled to give order and presenting a vehicle to a check-up for the purpose of comparing its engine, body and chassis numbers and color.
If defects are discovered in the presented documents, information is given to an applicant and state registration is implemented after removing them. A state official checkup card is given to a registered vehicle.
An official checkup is executed by an auditor (inspector) or a chief auditor (chief inspector) of the same bodies. A proper note is taken or a report is drawn up and attested by a seal in connection with a checkup result.
2.7. If it is impossible to present a vehicle for performing registration acts because of a technical failure and other reasons, a vehicle owner should note these reasons in an application and pay a complementary fee for a service rendered to him by state registration bodies. These bodies should hold a checkup for the purpose of comparing engine, body and chassis numbers, as well as color of a disabled vehicle by its location site within five days after giving a receipt on payment of a complementary fee.
Note: If the last day of a term shown in this item falls on a non-working day, the working day after this day is considered to be end of the term.
2.8. A vehicle owner or other person entitled to give order should present the following documents to bodies realizing state registration of vehicles within the period stipulated in this Regulation for carrying out state registration and permanent record-keeping of a vehicle, issuing registration certificate and state registration signs and performing other registration acts:
1) application;
2) An identification card of a citizen of the Azerbaijan Republic (a card on registration of a foreigner in the territory of the Azerbaijan Republic or an identification card of a person without citizenship for usage within the Azerbaijan Republic);
3) An appropriate document or a court decision confirming an owner's proprietorship in the order defined by the legislation of the Azerbaijan Republic;
4) A receipt on payment of dues or taxes, payings established by the legislation of the Azerbaijan Republic;
5) A permission document issued by customs authorities for a vehicle brought by legal and natural persons to the territory of the Azerbaijan Republic being bought from foreign countries, a document about removal from the permanent registration of a state where it has previously been registered, registration or transit signs of a vehicle.
2.9. Legality of vehicle ownership, purchasing and getting numbered aggregates are confirmed by the following documents: a deed of assignment of a manufacturing plant or a plant installing special equipment to a vehicle and a reference-account given by a manufacturing plant in connection with sale of a vehicle.
When a deed of assignment is lost, one of the below-enumerated documents should be presented:
An invoice issued by railway in connection with shipment of vehicle to the enterprise, a reference with vehicle chassis and body numbers written on it, passport, a certificate of a manufacturing plant; a final invoice issued by commission and trade organizations; an invoice given to citizens' property by the Ministry of Defense and due bodies of other armed units except the case of its sale, a final act of a military unit and an act on operating conditions; a reference of social security bodies in relation to giving hand-driven cars or motor waggons; a deed of gift, share and cancellation agreement attested in a legislatively defined manner; certificates relating to assigning property and inheritance rights on a vehicle, agreement of purchase and sale (Annex No.1 to the regulation) or Contract for Change (Annex No.2 to the regulation) compiled between a vehicle owner and a buyer in writing and certified at the Registration-exam points of the State Traffic Police of the Ministry of Internal Affairs of the Azerbaijan Republic.
An irrefutable term of correctness of a concluded contract is the presence of a seller and buyer (persons empowered by them) at the registration point. Additionally, a deed of assignment and a document on payment of the value of a vehicle or its copy and other documents, provided in appropriate legislation, are required when legal persons' vehicles are sold and procured.
2.10. New vehicles brought to the republic by enterprises, organizations and companies with legal status, registered at the State Traffic Police Department of the Ministry of Internal Affairs of the Azerbaijan Republic, qualified in sale and purchase of vehicles, for sale purposes are registered in the name of legal and natural persons, under customs documents for bringing these vehicles to the republic, a final invoice on sale, transit signs and other due documents provided in the article No. 2.8 of this Regulation.
2.11. Constructions of registered vehicles should be conformable with effective standards, rules and norms concerning traffic security and environmental protection. It is forbidden to bring right-hand drive vehicles to the Azerbaijan Republic and carry out their state registration.
2.12. If vehicles, freely installed and produced according to the article No. 2.11 of this Regulation, are compliant with an opinion of an technical control commission of the "Motorist" cooperation and "Technical requirements for individually manufactured vehicles" agreed with STP Department under the documents affirming lawfulness of purchasing aggregates, sets (assemblies), parts and materials in the name of vehicle owners, these vehicles is registered in the order specified in the article No. 2.8 of this Regulation. It is impermissible to assemble vehicles from spare parts of certain type vehicles produced by a manufacturing plant or repaired parts when vehicles are retired.
2.13. Vehicles, won by citizens when lottery is held during sport events at sport palaces, stadiums and in other cases, are registered in the order specified in the article No. 2.8 of this Regulation under a final invoice given by a shop. The opposite side of a final invoice is filled by members of a lottery commission and data on a person who has won an auto motor vehicle are written on this side and this final invoice is signed by and confirmed by a seal of a chair of a lottery commission and leadership of an institution holding an event.
2.14. Vehicles (confiscated, or unowned) sold by corresponding state authorities by means of commission commercial shops are registered in the order specified in the article No. 2.8 of this Regulation under a court decision (decree) or decisions of other competent state agencies and a final invoice of a shop. "The vehicle has been accepted and sold without its registration certificate" should be written in a final invoice given to a buyer and this note should be attested by a store manager's sign and seal in the absence of registration documents of a vehicle imported to a commission shop from financial or other state bodies.
2.15. Registration certificates and state registration signs, with a "Test" mark on them, are issued for not more than a one-year period to vehicles which have undergone control test in compliance with technical conditions of manufacturing and auto repair plants.
2.16. Registration certificates and state registration signs with a "Test" mark on them are issued during registration of vehicles passing a test, with test sample. Conformity of a vehicle with the security conditions provided in the requirements list and an expert opinion of a manufacturing enterprise on its being allowed to testing are taken as a ground for registration.
2.17. A vehicle, brought to the Azerbaijan Republic without being removed from permanent registration of a country where it has been registered, is provided with registration certificates and signs by being temporarily registered in the name of its owner under a permission document given by customs authorities. A permanent certificate is given to the previous registration place of a vehicle after receiving due confirmatory answer to the request given by a body realizing state registration via "Interpol" National Central Bureau of the Azerbaijan Republic. An appropriate consul certificate is presented to registration authorities when removal of a vehicle from the previous registration place is carried out by foreign embassy and consular representations in the Azerbaijan Republic.
Note: Vehicles, brought to the Azerbaijan Republic by refugees, IDPs and other persons before entry into force of the Law of the Azerbaijani Republic "On Road Traffic" and legislative acts on customs affairs, are registered under documents confirming their ownership and proper information is sent to a permanent registration place in this regard.
3. Registration features of foreiners and foreign legal entities' vehicles.
3.1. Vehicles, belonging to diplomatic and embassy representations, their collaborators, international organizations and their collaborators, publishing houses, radio, television agencies, banks, airlines and their collaborators, other legal entities and their collaborators, other foreigners who have come to the Azerbaijan Republic for a period not less than 30 days, are registered (repeatedly registered) in the order specified in the article No. 2.8 of this Regulation by mediation of service agencies of corps diplomatique of the Ministry of External Affairs of the Azerbaijan Republic or a ministry receiving foreign citizens and head offices and under a card on registering a foreigner by his/her place of residence and other registration acts are performed.
3.2. Vehicles belonging to foreign country citizens and persons without citizenship who permanently live in the territory of the Azerbaijan Republic are registered under general principles.
3.3. Registration certificates and state registration signs on the following series are issued for vehicles of foreign representations in the republic, foreigners and foreign legal entities enumerated in the article No.3.1 of this Regulation.
"SFR" series-for service and private vehicles of heads of diplomatic representations;
"D" series-for vehicles of foreign diplomatic (embassies, trade representation, or military attach, Consultants' Office on economic relations, as well as other sections being component of diplomatic or consular representations) or consular representations, other international organizations that are considered to be equal to an ambassador rank , collaborators of diplomatic-level organizations of these representations and their family members. "T" series state registration signs can be issued for vehicles at the request of diplomatic, consular representations and international organizations.
Diplomatic, consular cards issued by the Ministry of External Affairs of the Azerbaijan Republic should be presented in order to issue "D" series state registration signs for private vehicles;
"T" series-for vehicles of family members of administrative-technical and service staff of diplomatic, consular representations, other international organizations or their collaborators.
Service cards issued by the Ministry of External Affairs of the Azerbaijan Republic should be presented in order to issue "T" series state registration signs for private vehicles;
"M" series-for vehicles of collaborators of foreign companies, banks, airlines and other international organizations opened in a defined manner in the territory of the Azerbaijan Republic, as well as collaborators of the same representations accredited in the Azerbaijan Republic and their family members.
A card on registering a foreigner by his/her place of residence should be presented in order to issue "M" series state registration signs for private vehicles;
"K" series-for vehicles of representations of foreign mass media, collaborators of these representations and their family members.
Correspondent cards, cards, issued to technical staff by the Ministry of External Affairs of the Azerbaijan Republic, should be delivered and a card on registering a foreigner by his/her place of residence should be presented to collaborator's family members in order to issue "K" series state registration signs for private vehicles;
"H" series-for vehicles of Azerbaijan-foreign country joint ventures headed by foreigners or their foreign collaborators; vehicles of foreigners visiting Azerbaijan Republic on business, or private business, for studying; vehicles of persons permanently living with an ID card in the republic, or persons without citizenship; vehicles rented to foreigners.
A card on registering a foreigner by his/her place of residence or ID cards of persons permanently living in the territory of the Azerbaijan Republic, without citizenship should be presented in order to issue "H" series state registration signs;
"P" series-for vehicles removed from registration in connection with taking abroad once and for all; for vehicles bought in the Azerbaijan Republic and finally withdrawn from the republic by foreigners and foreign legal entities.
Series of state registration signs are issued to trailers of auto motor vehicles belonging to foreign legal entities and foreigners.
SFR, D, T series state registration signs have red background and a white symbol.
M, K, H, P series state registration signs and state registration signs related to trailers have yellow background and a black symbol.
3.4. When sold (given to other person), registration of vehicles, brought from foreign countries for their own needs, for subsequently selling in an internal market, is carried out in the name of their new owners under documents certifying legal documentation of a transaction (final invoice, a deed of gift etc.), permit of customs authorities (on the condition that customs duty should be paid) and other documents provided in the article No. 2.8 of this Regulation
